A Federal Capital Territory Chief Magistrate Court in Abuja has thrown out a defamation case against Nollywood star Elizabeth Aishat Anjorin, widely recognized as Lizzy Anjorin, declaring the charges baseless and improperly filed.
The case, identified as CR/25/20225, was initiated by Audullahi Adebimpe Mosadoluwa, spouse of prominent Lagos property developer Ibile, but was dismissed due to legal technicalities.
Presiding Magistrate Sunday A.A. Adukwu not only struck out the lawsuit but also imposed a ₦50,000 fine on the complainant for legal costs incurred by the defendants.
Anjorin and her co-accused, Shakira Ayobami, contested the lawsuit through their legal representative, A.U.E. Ogboi, arguing jurisdictional errors and procedural flaws in the complaint.
Mosadoluwa had alleged criminal defamation, incitement, and false statements against the duo, filing the case through her attorney, Yakubu Eleto, who raised concerns about improper summons and court processes.
After examining legal precedents and arguments, the court ruled entirely in favor of the defendants, citing the complainant’s failure to comply with the Administration of Criminal Justice Act, 2015.
Magistrate Adukwu emphasized that the complaint unlawfully bundled multiple charges into one case, violating legal procedure. Additionally, he noted that all involved parties reside in Lagos, not Abuja, further undermining jurisdiction.
The judgment described the case as procedurally defective and an abuse of judicial process, leading to its dismissal with costs awarded against the plaintiff.
This verdict reinforces legal safeguards against improperly filed lawsuits, particularly when jurisdictional and procedural lapses are evident.
